Court Pick

The sad death of Supreme Court Justice Ruth Bader Ginsburg has added a new twist to a presidential election already full of twists. Democrats are still stinging from the Garland Merrick non-vote from 2016 as the clock wound down on the Obama presidency. The Republican lead Senate engaged in what basketball fans previously called the "4-corners" stall tactic until the election opened the door for a GOP nominee.

The Democrats seek the same result but the math is simply not in their favor. The Republicans still enjoy a (slim) Senate majority which paves the way for a straightforward nomination and confirmation. Indeed, history tells us that Supreme Court appointments will occur 90% when the same party controls both the White House and Senate during election years. Now, please do not interpret this statement as my prediction that eh nominee will enjoy headwinds and smooth sailing.

This is still 2020.

The death of Supreme Court Justice Ruth Bader Ginsburg was a devastating day causing both grief and uncertainty. Unfortunately, her death focused on discussions of how it affected the government and possibly weighed elections rather than her accomplishments and persona. I can understand that when her news was announced many felt that 'everything is going wrong' and relied heavily on the government body and their efforts during the COVID-19 pandemic. I remained neutral about the effects that may occur to losing not only a supreme justice but a good person as well because there is nothing God gives us that we can't handle.

The death of Ruth Bader Ginsburg was a sad day because she truly embodied servant leadership. She was an interesting figure, not only because of her personal style and hard work, but also because she was a role model for many women that balance motherhood, marriage, and career. She fought her entire career for gender equality while facing those same challenges in her own life.

While the Republicans stalled so that President Obama could not get Justice Scalia's replacement completed with Merrick Garland, President Trump was able to get Amy Coney Barrett through because Republicans had the numbers.

The Death of Justice Ruth Bader Ginsburg caused major differences to arise between Republicans and Democrats at the peak of a tight 2020 election race. On one hand, the Democrats believed that the nomination should wait until after the election because the country was in such an interesting time. On the other hand, Republicans wanted to nominate and appoint a replacement while Trump was still in office. The job of a sitting president is to nominate replacement Judges to vacant Federal court seats, so the Republicans did not do anything against the law, but it was frowned upon by Democrats. This is mostly due to the way the Republicans were able to delay President Obama’s Justice nomination before the 2016…

Three months after this post was posted. ACB was confirmed but was met with quite an unwelcoming welcome. Now she is on the Supreme Court that may have to ultimately decide the election outcome. People have asked that she acquit herself of the ruling if it reaches the court because she has a conflict of interest. In my opinion, I do not believe she does she may have been given the job by Trump but by no means does that means she owes him with a second term if that is not what the American public voted for.
